Placement Setback and Stack Height Requirements Categories

Is there a residence on an adjacent property?

  • NO – No stack or setback requirements.
  • YES – Go to number 2.

Is there an adjacent property with a residence* less than 500 feet but more than 200 feet from the Outdoor Wood Unit?

  • YES – Your stack height of the Outdoor Wood Unit must be equal to or taller than the roofline of the residence it serves OR above the roofline of any adjacent property, whichever is less.
  • NO – Less than 200 feet separation, go to number 3.

Is there an adjacent property with a residence less than 200 feet but more than 25 feet?

  • YES – Your stack height of the Outdoor Wood Unit must be 20 feet high OR the height of the roofline the Outdoor Wood Unit is serving, whichever is greater.
  • NO – Less than 25 feet separation, go to number 4.

Is there an adjacent property with a residence less than 25 feet from the Outdoor Wood Unit?

  • YES – Your stack height of the Outdoor Wood Unit must be at least 3 feet greater than the roofline of the highest adjacent residence.

*The separation distance is measured from the Outdoor Wood Unit stack center to the nearest point on the closest building on an adjacent property.  The building must be a residence, used by people as their primary dwelling place.

Note:  “Grandfather” clause – refers to an existing Outdoor Wood Unit.  These units are not subject to this policy UNLESS a signed written complaint is filed and verified to be causing a Human Health Hazard by the Taylor County Health Department.  An existing system may be repaired but not replaced.  If replaced or new it is subject to this policy.

Note:  In the event that a dwelling is constructed on an adjacent property after the installation of an Outdoor Wood Unit, the owner of the Outdoor Wood Unit must then comply to the requirements of this policy.
